Welcome to blablafrench.com, the website and online service of Blablafrench (hereinafter : “we”, “us” or “Our site”). These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and Bla Bla French. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of Our Site. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Access to Our Site 

Access to Our Site is free of charge. 

It is your responsibility to make any and all arrangements necessary in order to access Our Site.

Provision of the Service

Who can use our Services: You may use our Services only if you can form a binding contract with Blablafrench, and only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations. Any use or access to the Service by anyone under 13 is strictly prohibited and in violation of these Terms. Users between the ages of 13 and 18 must obtain written permission from a parent or legal guardian. Your right to use our Services is personal to you and is not transferable by you to any other person or entity. Blablafrench reserves the right to terminate your use of its services, for example if you demonstrate abusive or inappropriate behaviour.

Blablafrench provides an online learning platform for French where both Students and the Teacher can collaborate with each other and take advantage of the services (collectively, the “Services”). The Services provided are as follows:

Connection Services. Blablafrench advertises their services to Students. Students are able to browse the Teacher profile and engage with the Teacher for the purposes of language learning. Students are able to coordinate lessons bookings via our software. 

Payment Services. Blablafrench provides Payment Services to Students. Students are able to purchase lesson credits, which they can then apply in the booking system in order to schedule lessons with the Teacher.

French language lessons : After purchasing lesson credits, students can book lessons on the booking system and get in contact with the Teacher via a communication software such as Skype to have the lessons on the time and date selected beforehand. 

Payments & Refunds 

Students can purchase lesson credits using Paypal as an online payment service. Lesson credits are valid for 12 months from the day of the purchase. Lesson credits can be applied in the booking system for the purpose of scheduling lessons. All prices stated exclude any additional charges such as fees, taxes or interest charged by the Student’s bank or credit card company. These charges are the sole responsibility of the Student. The prices stated also do not include any costs associated with connecting to the internet. 

Students are able to receive a refund to the value of their remaining lesson credits if they contact Blablafrench (at leyla@blablafrench.com) to request their refund within 14 days of their initial purchase. The refunded amount will equal the value of the remaining lesson credits in the chosen purchase currency.

Booking Policies

A lesson can be cancelled or rescheduled by the Student if at least 24 hours are remaining until it is due to begin. The Student must reschedule/cancel the lesson via the booking system. If they cannot see how to do this, they should consult the instructions found on the Site’s FAQs page. When there are less than 24 hours remaining until the lesson is due to begin, the Student does NOT have the right to cancel or reschedule and the lesson credit will be lost. The Teacher is able to make exceptions if they wish, however they are under no obligation to do so.

If the Student misses their lesson, they will not be able to reschedule or cancel it and their lesson credit will be lost. Lessons scheduled during local holidays will not be cancelled automatically — it is the responsibility of the Student to make any necessary changes to their bookings. 

Managing Your Information

It is the sole responsibility of each User to ensure that all personal details (e.g. contact details, payment details) are up to date and accurate at all times. By accepting these Terms, you hereby release Blablafrench from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected disclosed and undisclosed, which arise due to inaccurate personal information being held on the site.  You are also responsible for safeguarding your account password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Blablafrench account, whether or not you have authorised such activities or actions. You will immediately notify Blablafrench of any unauthorised use of your account or lesson credits.

Technical Requirement 

The Student is is responsible for ensuring they have 1) a sufficiently fast and reliable internet connection and 2) the necessary software and hardware for learning via Blablafrench. This includes a Skype account and the necessary audio equipment. If a lesson is disrupted or cannot go ahead as a result of technical issues from the Student’s side, the Teacher has the right to charge for the lesson. If the Teacher has technical issues, the lesson must be cancelled in the system so that the Student’s credit is not used.

Free Trial Session 

New Students are permitted to take a “Free Trial Session”. This session is only available to first time students, and is limited to one session per Student. The trial session lasts approximately 30 minutes. After taking this session, the Student can decide, without commitment or obligation of making a purchase, whether to proceed with purchasing lesson credits.

Intellectual Property Rights 

All of Blablafrench’ materials, including website content, articles, images, and audio and video files remain at all time the sole property of Blablafrench. Such aforementioned materials are protected under international copyright, trademark and other intellectual property laws. You may not post, distribute, sublicense, translate or reproduce in any way any copyrighted materials, trademarks or other proprietary information without the prior express written consent of Blablafrench.

Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Our Site.

Our Site has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Our Site shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Information We collect, How We Use it & Why

When a user signs up for a free trail session on blablafrench.com, we are required to request and store the user’s email address and other relevant information. This is because the user needs to receive email communications regarding the trial session and the Teacher needs to know certain things in order to provide the service. The information required at this stage is: Name, email, age range, estimated language level and motivation. The user can also optionally provide their phone number and Skype ID to improve communication and receive session reminders. If the user opts to take lessons without a trial session, the only information required is email and full name.

We store the data mentioned above for the purposes of 1) enabling lessons and trial sessions to be scheduled, 2) allowing the Teacher to be able to provide their services, and 3) enabling Our Site to ably deal with any issues. The data is stored within third party software system (Acuity Scheduling), which uses the latest security technology and are compliant with the GDPR.

After users sign up for a trial session, they may receive emails regarding their request. Users may also receive occasional emails regarding updates and special offers. You can opt out of receiving emails by clicking the unsubscribe link in emails received.

When you visit blablafrench.com, we may track browsing activity and later analyse it for the purpose of better serving our users.
